Environmental law cannot be limited solely to the study of government actions.
The most recent examples point to what is undoubtedly a growing demand for citizens to have the direct right to take action against those they believe are harming the environment.
Beyond this single issue, however—and more specifically the all-too-important matter of compensation for damages—other questions remain. The concept of the public interest may no longer be viewed in the same way. The commitment to combating climate change requires the involvement of private actors as well.
The enforcement of private law contracts sometimes poses challenges specific to environmental protection, and this will likely become more common in the future.
For the past twenty years, the remediation of designated sites has posed numerous challenges, regardless of whether the operating company is still in business, undergoing restructuring, or even in bankruptcy.
The aim of this event is to go even further and explore the concepts and ideas underlying what this private environmental law might entail, and to identify, through an analysis of the issues and certain challenges, the potential goals that could be set for it.
